This statement is formulated in accordance with the Export Control Law of the People's Republic of China, the Cryptography Law, and related administrative regulations. All visitors, potential and actual customers, must acknowledge and adhere to the following legally binding terms.
1.1
Many products operated by our company fall under the definition of dual-use items as stipulated in Article 6 of the Export Control Law of the People's Republic of China. Their export is strictly regulated by Chinese law.
1.2
Certain products (such as cryptographic equipment, security chips) are simultaneously regulated by Article 28 of the Cryptography Law of the People's Republic of China and are included in the National Commercial Cryptography Import/Export Control List.
1.3
According to the explanation in Article 3 of the Catalogue of Dual-Use Items and Technologies Subject to Import/Export License Administration, the import/export of items and technologies listed in the Catalogue, regardless of whether a specific customs commodity code is indicated, shall be subject to the relevant dual-use item and technology import/export license procedures in accordance with the law.
2. End-User and End-Use Obligations
2.1
The customer undertakes that it is the end-user of the products, or has obtained legitimate authorization to procure for the end-user. In accordance with Article 15 of the Export Control Law, the customer is obligated to cooperate by providing truthful and complete end-user and end-use information to assist us in applying for necessary export licenses.
2.2
The customer guarantees that the products will be strictly limited to civil, commercial, and industrial applications. The customer explicitly acknowledges and undertakes that under no circumstances shall the products be used for any military purpose, any activity related to weapons or weapons of mass destruction (WMD), or any other use that may jeopardize China's national security and interests (Export Control Law, Article 17).
2.3
Product use must comply with all applicable international, national, and local laws and regulations.
3.1
Without the prior written consent of our company and obtaining all necessary Chinese re-export licenses, the customer is strictly prohibited from re-exporting, transferring, reselling, or otherwise disposing of the products, their technology, or derivative products to any third party.
3.2
The customer bears full responsibility for the downstream compliance of its supply chain.
4.1
Based on our company's internal compliance program and independent risk assessment established in accordance with Article 11 of the Export Control Law, our company's products and technologies are explicitly prohibited from being exported, transshipped, delivered, or used in any form, directly or indirectly, to/in Japan (including all its territories).
4.2
This prohibition is a fundamental commercial and compliance policy of our company, applicable to all transactions. The customer must not circumvent this restriction through any intermediary.
To fulfill our obligations as an export operator under Chinese law, our company and competent Chinese government authorities retain the right to verify the end-use and location of the products. The customer agrees to provide necessary access and documentary support for such compliance verification.
Should the customer violate any term of this statement, particularly those concerning military end-use, unauthorized re-export, or violation of the Japan export prohibition, our company will immediately take the following actions:
(a) Terminate all existing contracts and cease shipments;
(b) Pursue all economic losses caused by the customer (including fines, reputational damage, and legal fees);
(c) Report the violation to the competent authorities in China and relevant countries in accordance with the law.
This statement constitutes a legally binding agreement between our company and any recipient of our products. Our company reserves the right to update this statement at any time. This includes, but is not limited to, the right to claim compensation for all losses.
